Walmart in particular is very culpable in this matter.

My girlfriend worked for Walmart years ago. She has told of how the Black Friday even is such a big deal that Walmart execs plan for it months in advance. But what makes it so bad is that they *want* the customers out of control. It is not at all uncommon for a Walmart store to do what this one apparently did: to put employees among the crowd and get them whipped into a frenzy by the time the doors open.

She speaks of how one of the big events for the employees was to later talk about all the fights that broke out among customers, especially when inventory began to dwindle.

Yeah, Walmart not only needs to be penalized for this incident, they need to be prohibited from doing it ever again.

Don''t know where ThinTheHerd got his education, however, being an attorney myself...yes, Walmart is liable. ANYTIME anyone is injured on your property, you are liable. Also, as another stated, any place of employment must provide safe working conditions for their employees. The crowds are also to blame for their stupidity and lack of compassion, but Walmart should have known from past experiences. Their only concern is the almighty $$$$$.

I understand the Wal-Mart store in my town makes more in a day than the store I work in makes in a year. Big bucks.

The people in charge of the Wal Mart Black Friday sale need to be disciplined by the courts.

So because they make "big bucks" they should be held accountable for ignorance of people? Yeah makes sense to me.

deepperppl You sound like a disgruntled employee.

I''ve been to one Black Friday sale. I was up and out the door at 4:30, ready to enter a store at 5 AM. Well, turns out that the store I chose, which fit my wish list best, wasn''t the most popular store for the early birds. I spent a quiet morning buying for family and friends and have never been to another Black Friday since. I tend to spend very little on gifts even when I don''t go to Black Friday events. So why get up early and try to beat the crowds when it really doesn''t impact my bottom line?

The people in charge of the Wal Mart Black Friday sale need to be disciplined by the courts. I''m glad the suit was filed and I have every confidence the big W will not get out of it unless they offer a hefty settlement.

Walmart messed up big time.
For a crowd of that size, you need proper security guards to handle crowd control. Not one just one employee. The guy was put at serious risk. Just another example of how Walmart management mistreats their employees.

No, I have never, ever gone to a Black Friday sale. That is not what Christmas is all about.

While I agree that this is not what Christmas is about, I don''t agree that Black Friday should be cancelled. I guess if we do cancel it, then we should cancel the White Elephant Sale(the one that happens in January) as well as any 4th of July sales, the Memorial Day sales and ALL the other sales that we have to celebrate an occasion. Oh hell let''s just cancel Christmas and New Years, let''s cancel Labor Day, Hanukkah, etc. or any occasion that we have to celebrate, because someone died. Oh screw it, cancel life!! We don''t deserve to have fun because of a few morons at a Walmart store, woke up one morning and left whatever decency and common sense they were raised with, at their front door.

Q - Why do they even call it "Black Friday"?

A - Because it is widely believed to be the day that puts retailers back "in the black" finance-wise. This refers to a time when finances were written in red for losses or expenses and black for profit or income.

We actually found that we can get a lot of our next year Christmas gifts after this years Christmas unless of course you want the newest and greatest video game, cell phone etc. And is many cases the sales prices were a lot lower than on Black Friday for the retailer is trying to get the stuff of the shelve.

Wonder how long it takes people to realize that they can get the same if not better sales on Black Monday on the Internet.

Shopping without getting trampled to death --- PRICELESS

For everything else -------------- LOL

I went to the sale for the first time in years with my daughter to maximize on the few bucks we had to spend to get a few things for the children. I was very happy with the bargains I was able to get and also had some fun doing it with my daughter. However, the electronics department was log jammed, and I wasn''t there for the electronics.

While I am not a big Walmart fan,I do not believe
they are responsible for this horrible act. Those
brain less people acting like vultures are solely
to blame.I am 49 years old and have worked in retail
since I was 17 and I know how crazy people can act.
I hope this haunts all these people involved on
christmas as their opening their gifts and every
year here after,it''''s what they deserve.

I agree with you. It is not the responsibility of the retailer what so ever. Controlling a crowd that acts like a bunch of savages is beyond every non law enforcing entity. They are not trained for it. I hope that once they see those responsible for trampling this poor guy to death these individuals will be held accountable to the full extend of the law. It%u2019s called negligent homicide and should be handled as such. I am even more disgusted by those that screamed when Walmart closed the doors due to the incidence. Just shows how primitive people can be. Let%u2019s just be grateful that no new economy boosting checks were send out from Washington.

The lawyers are right - for once. They set up a sale to create a frenzy - a very few extremely good bargains, placed somewhere in the store -
Posted by Questionnews

Oh balderdash. You are saying that no lawyer, or lawyer''s spouse or significant other or child has ever gone to one of these sales? I hardly think so. The lawyers are just as greedy as the retailers. They see an opportunity to make money and they are going for it.

Maybe Wal-Mart will be next to ask the Govt for a bailout? Personally the family should sue the ones that trampled him but I suppose their would be no money in that

At the Walmart store that I went to at 4:30 a.m. on black Friday, while it was crowded like CRAZY, people were saying, "I''m sorry," and "Excuse me." Maybe the family should sue the people who did the trampling. Just because there is a sale at a store, it doesn''t have to follow that all reason, logic, social graces, and humanity be d a m n e d.

If the people in line would have acted like mature adults, none of this would have happened. This kind of thing makes me realize that we as human beings, are not as advanced or evolved as we think we are. Such a waste of human life-the people who pushed the doors down and caused that man''s death should be ashamed of themselves.
