mbcsmith - Your Republicans brought the detainees here instead of leaving them in Iraq or Afgahanistan and potentially provided them entry to the US -- I believe the issue is more or less in their court to fix the problems their arrogance and ignorance have created. Please support them by recommending a solution and not dumping the problem on others that had no say in the creation of the issue. The Republicans made the problem they should begin proposing solutions.

Actually, in 1995-96 Clinton tried to get anti-terrorist legislation passed, but Republicans were against many provisions that they thought undermined civil liberties and due process. The bill was actually pretty similar to the patriot act.

In the Senate as S. 390 and in the House of Representatives as H.R. 896.

mbcsmith - Numerous Executive orders and administrative policies were overturned long before this administration requested any laws from Congress and to my understanding the Military Commissions Act was negotiated between the administration and congress and has only been partially overturned which is more than can be said for the administrative actions that preceded them.

The AG''s representative to illustrate how completely the administration has messed up the detainee issue at the hearing said DOJ had no recommendations how to fix the detainee release issue and that the issue needed to be resolved by the Congress using its own experts. Apparently the Bush Administration is unwilling or unable to address in any way beyond identification of the issue the serious issue and danger they have created in bringing the detainees to Gitmo.

In terms of the military/criminal treatment of terrorists -- the number of losses by the Bush Administration in Courts most recently before three Republican appointed appellate judges as to the insufficiency of the current procedures does not scream out for some change?

The LAWS you refer to were CREATED by congress and then revised by the current congress. It''s not Bush''s laws, but the laws of the United States

AG Mulkasey and the DOJ before Congress pleading for a law to prevent the release of the Gitmo detainees into the US because the Bush administration relied on their own flawed legal reasoning in admitting terrorists into US territory in Gitmo does not scream out for a change in administration policies? Do you want a Gitmo Detainee released into your neighborhood because of the Bush Administration''s gross incompetence and negligence?

How does a story about W''s speech turn into a Bob Barr publicity story? Geez.....

The way I see it the Republicans have sipped too much of their own kool-aid and are believing their own press. Let''s keep America scared is the mantra of the party or so it sounds. Of course, W has long since gone over the neo-con edge and can''t envision an America without fear. McCain couldn''t make his own decision if he had to....so it leave us with only one choice for President. Has anyone noticed that the Obama campaign hasn''t slung any real mud. They''ve defended their position but not mud slung. I think that''s what the American people are watching. Obama in a landslide in November.

I submit for the above reasons a significant increase in the use of criminal procedures and the replacement of war/warrior designations with criminal designations would positively impact both of the above issues reducing terrorist recruiting and uniting world opinion and increasing international cooperation to restrain terrorist activities.

The above has been recommended by several think tanks both conservative and liberal but ignored by Bush and McCain.

Bush''s Post-Surge Diplomatic Failure.

Bush needs to sign a SOFA to replace the US Authorization in Iraq before it expires in December. The Iraqis insist the SOFA include a time line (expressly not a time horizon for aspirational goals) to remove combat troops by the end of 2010 (before Jan 1, 2011) otherwise known as Senator McCain''s Time Line of Failure.

Will the agreement with the Time Line of Failure be signed before or after the US election? It is already late the original date for completion was the end of July.

In his remarks, Bush said the war on terror "cannot be won, however if we treat terrorism primarily as a matter of law enforcement. Law enforcement is an essential part of our strategy but our strategy cannot be limited to law enforcement alone."

This is part of the "forever war" and forever need to take our freedoms in the name of protecting us strategy, where they bleed the citizens of America of their money and funnel it to the military industrial complex thus producing Concentration Camp America.

They want us to be afraid of even one person being able to cause great harm on the rest of us to justify turning our country into a police state.

The true terrorists are the Bush/Cheney/Saudia crime syndicate that are responsible for the 911 black ops twin-tower demolition missions, including the anthrax attacks.

We must hold war crime trials against this administration for the genocide of more than a half million senseless deaths in the mideast caused by the 962 public lies (wmd, wmd, the sky is falling)for the oil and military industrial profits and to usher in their version of 1984.

If you support these criminals, you are supporting terrorism.
