I wouldn''t call it "brainwashed" but the answer is an unequivocal, unqualified "yes".
The circumstances under which one person kills another is as important or even more so than the act itself. The message I am attempting to send is when Authority metes out punishment for an unspeakable act, it isn''t so much the person being punished or even the act itself, but the attitude and core values that person holds to that permits him to do the deed in the first place.
If I kill an Mexican immigrant (assuming I''m not one myself) because he attacked me; because I acted recklessly; because I was careless; because I was in a drug induced state; accidently while I was robbing him - whatever. The dude is still dead and his family probably would''t care much why I killed him. What I did was still homicide and still reprehensible.
But..If I kill a Mexican immigrant BECAUSE he was a mexican immigrant, then I am acting from a core belief that a personal characteristic my victim holds renders his life less valuable that other lives. That is a whole deeper level of unacceptability and SHOULD be more severely punished.

Besides, once you issue the first ''shoot to kill'' order for a suspected criminal violation, how long before the second ''shoot to kill'' order and how many, eventually, do you end up with?

I strongly support enforcing immigration laws, but i do not believe killing is a necessity to do so. I do not think there is any way to legally or morally justify this killing. The man was breaking our immigration laws, but that does not warrant a death sentence.
