- This "not a sitting judge" BS needs to be put down. This is the body that makes the ultimate determination of the meaning of our basic constitutional rights. We need someone who will make those calls based on the historical legal meaning of the Constitution, not on their own biased and irrelevant political/religious/social agenda. Sitting judges may not be perfect, but the idea that "life experience" is at all relevant to answering technical legal questions is moronic. More than someone's politics, I care about someone's qualifications to do carry out the responsibilities of the job. This isn't just a "judge" position, it's one of the most important such positions in the world. A judge should fill it.

While this isn't quite the same as a law-degree and practice, I would view this background and experience as a big step over the typical laymen's position to debate this stuff from.

If true, I'm sure you don't believe Obama is unique in this or that most prior presidents aren't also just as guilty. Would you feel comfortable practicing law, defending a friend or family member in court?
Do you believe a person who has studied law in a 4-year university has no advantage over yourself on these matters?

- I have to say as is rare lately Mr Cohen wrote an unbiased piece in which he states will result in a liberal justice and as far as needing to couch their answers carefully. Why should nominee? With a substantial majority in the senate the democrats will approve whoever he nominates. The answers to the questions will be irrelevant. Having hearings seem unnecessary. They will since it gives them a chance to show off.
Any questions by dems will be softballs and the pubs will ask tougher questions or at least more pointed and the nominee will give a non answer answer.
Yes liberal justices no longer think THAT The constitution is the final say. They now look to international law to decide American judicial issues - Reply to this comment
