Andrew Cohen: Republican Presidential Nominee Parrots Party Lines Bashing Judges
- Some of the comments on this website have claimed that a majority of Americans are in favor of abortion on demand. If that is true, why hasn''t Congress passed a law legalizing abortion? If a majority of the people want it, should be no problem to pass such a law, right?

- Andrew Cohen clearly indulges in the kind of legal thinking that allowed the US Supreme Court to find a "penumbra" (aura) of legal rights created by the confluence of some other actual amendments to the Constitution. The justices then went on to "find" in this non-existent "penumbra" that abortion on demand was legal. This is simply mumbo-jumbo. If the proponents of abortion wanted to legalize abortion, why didn''t they simply get Congress to pass a law, since the Constitution doesn''t address abortion. Or amend the Constitution - then the right would actually be in the Constitution. The answer is: the people didn''t want to amend the Constitution to permit abortion and Congress wouldn''t pass such a law and neither would any state legislature. So they circumvented the law by using "activist judges" to find a constitutional right in the Constitution that wasn''t there. This tiny elite - tiny - overroad the entire democratic apparatus set up. This is a republic, not judicitocracy. By the way, Roe v Wade is but one of many, many cases where the tiny elite actied to do what the people and the Congress wouldn''t do. Neat, huh? If you can''t get legislation passed or the Constitution amended, just get the justices on the Supreme Court to override the will of the people.

- Andrew Cohen is big on his half truths, innuendo and intentional deciets. We elect Legislators to make the law, and appoint judges to interpret them. We have had too many instances where a judge invented a new legal more out of whole cloth, or even "inspiration".

This is an opinion article though, so I suppose it''''s alright to be biased. However if this were an actual news article, of course it would be too biased. I''''m against bias of any sort, Liberal or Conservative. The public should decide what they think.

This op-ed piece''s bias is neither liberal nor conservative.
It is directed squarely at the hypocrisy of attacks on the judicial system by demagogic politicians & the voters who empower them. - Reply to this comment
- Notice how he has nothing to say about the crisis with the destruction of our food source for ethanol? But Iowa corporate farmers just love him.

Of course he does, he has to, he''s pandering like crazy to get the right wing support, but they''ll never trust him.
I don''t think the Republican''s can suppress enough votes this time to win. Even with the help of the Supreme Court. - Reply to this comment

How''s that? I mean YOU have to explain this one to me because so far I''ve heard NOTHING but STAY the COURSE out of him... How does he intend to save Social Security? How about Medicare? Is he willing to continue without end the involvement in Iraq? What about the debt... 9.5 TRILLION and growing by the minute. How''s he going to just slow that down by staying with Trickle Down? No I''m afraid he''s said NOTHING that is any different than the WORST in US HISTORY! Sieg Heil Bush - Reply to this comment

- oldone60...I guess I have a few years on you. As much as it may come as a surprise to you I also worked hard all my life and became very successful. I paid my taxes and I biotched about it every year just like everyone else. But you what....I was glad to see social programs passed that helped other people less fortunate than myself. You see, I think it is my duty to be my brothers keeper. I realize that life doesn''t give everyone the same chances. Some are born into situations that they cannot control and some have tragedy forced upon them. We have investments that we are fortunate to have. We paid over 130 thousand in taxes this year. The only thing I regret is that the tax we paid went to fund an illegal war and brought pain and suffering to my fellow man. But that''s the way it goes. As for means testing...it''s an idea whose time has come. Otherwise the system will likely colapse and you won''t get a penny. God only knows that your kids and grandkids won''t because they will still be paying bushes debts. How I long for the days of the level headed republicans who had the sense to work along side the democrats to do what was best for the country. But you stick by your guns. You''re an American and you have that right. I personally wish you the best and I hope your senior years are filled with happiness and good fortune. Just because we do not agree does not mean that we have to hate each other. Semper Fi.
