Jaycee Dugard to California: Why Wasn't Anyone Watching the Garridos?

PLACERVILLE, Calif. (CBS/AP) Jaycee Dugard and her family have taken the first steps towards suing the state of California for lapses officials made while Jaycee and her daughters were allegedly held captive by Phillip and Nancy Garrido.

Dugard, her two daughters by Phillip Garrido, and her mother Terry Probyn, have each filed forms against the Department of Corrections, claiming they endured "psychological and emotional injury" while held against their will by Phillip Garrido and his wife.

They submitted the forms in January within the standard 6 month time frame to file.

Garrido had been under parole supervision after he was convicted of raping a 25-year-old in 1977. Released in 1988, he was placed under federal supervision until 1999, when the state of California took over.

The state's Inspector General's Office says mistakes were made right away, beginning with Phillip Garrido being wrongly classified as a low-risk offender. Also, one agent did not try to confirm the identity of a young girl, presumably Dugard, who he saw at the house while on a visit, instead trusting Garrido's claim that she was his niece. California's Corrections Department has acknowledged serious errors in handling the case.

Prosecutors say Dugard was kidnapped in 1991 outside her South Lake Tahoe home and taken to Antioch, Calif. by the Garridos, where she had two daughters by Phillip Garrido and lived in a tent in the backyard.

Dugard's spokeswoman, Nancy Seltzer, said the family hasn't decided whether they'll file a lawsuit. "We are simply preserving Jaycee Dugard's right to file a lawsuit at a later date, if that is something she decides is in her family's best interest," Seltzer said.

by GoJaycee March 3, 2010 1:54 PM EST: I agree our country is too lawsuit-happy, but if there is ever a justified lawsuit, THIS IS IT! The State screwed up every which way and then some! HOW DARE the judicial system given Phillip "rights" to speak to his insane wife, co-conspirator, via phone in jail! These scumbags deserve NO RIGHTS AT ALL! What is wrong with our system that allows this insanity?? THEY KIDNAPPED AND RAPED JAYCEE FOR 18 YEARS, ISN'T THAT ENOUGH? AND NOW THEY ARE TRYING DESPERATELY TO CONTACT HER AND THE GIRLS! Why would OUR STATE allow them to confer together to develop NEW ways of manipulating her? I also find it interesting that the daughters have both been appointed lawyers, but NOT JAYCEE!! The judge couldn't find any "legal reason". Excuse me, but isn't JAYCEE the one victim that NEEDS PROTECTION ASSISTANCE?? While the system is quick to provide the RAPISTS and THEIR CHILDREN attorneys, WHERE ARE JAYCEE'S RIGHTS?? WHO IS LOOKING OUT FOR JAYCEE'S INTERESTS?? I CRINGE everyday to think that the judge may allow the rapist's lawyers access to Jaycee's addresses any day now. Why isn't the public MARCHING against this outrage?? All these lawsuits need to stop. That is the ruin of this country. It just sucks all the money out of the taxpayers. Of course, they were not doing their jobs properly and should be dismissed, etc. But, the real person who should pay(once found guilty) should be Garrido & his wife.

by hankram March 2, 2010 5:42 PM EST: No, she and her family ought to sue the holy **** out of the State and their glorified doughnut eaters. If the people of California, my State, would have elected better leaders and they in turn appointed responsible people, all of those Parole Officers would have done their jobs yesterday. I also wonder about the case of Chelsea Hill. Was her alleged attacker still on Parole, and if so, wasn't he wearing his ankle bracelet, and why was he visiting his mom's house, near a school? If they find her, alive or worse, I guess Jessica's Law should be renamed, "words on toilet paper".
