Josh Brent, Dallas Cowboy player accused in fatal car crash, had alcohol level twice the legal limit, report says

(CBS/AP) IRVING, Texas - Dallas Cowboys' defensive lineman Josh Brent had a blood alcohol level twice the legal limit when he crashed his car killing passenger and teammate Jerry Brown, the Dallas Morning News is reporting.

Brent is charged with intoxication manslaughter in the accident that killed the 25-year-old Brown, an expectant father who just landed a spot on the Cowboys' practice squad.

It was previously reported that Brent failed a sobriety test immediately after the crash and refused to take a breathalyzer test but authorities were allowed to take a blood sample against his will because a fatality had occurred. Brent's blood alcohol level was 0.18 at the time of the crash, according to the Morning News which cites a law enforcement source close to the investigation.

The lineman was arrested at the scene of the accident on suspicion of driving while intoxicated and the charge was upped to intoxication manslaughter after Brown died.

According to a probable cause affidavit released Sunday by Irving police, officers said they detected "a moderate odor of alcohol" from Brent's breath and that he "admitted to consuming alcohol at a club." Police said Brent gave a blood sample at the hospital on Saturday, Dec. 8.

Data shows that the time period from Thanksgiving to New Year's Day includes some of the most dangerous days for drunk driving, and recent studies prove it is becoming even more of a problem. While annual drunk driving fatalities are down, there has been an increase in the proportion of these deaths around the holidays.

To increase awareness of drunk driving, Mothers Against Drunk Driving (MADD) is launching its signature red ribbon campaign for the 26th year in a row. The Tie One On For Safety Campaign encourages drivers to display red ribbons on their cars as a pledge to drive sober.

As part of its awareness campaign, MADD is reminding drivers of the real dangers of drunk driving. In 2010, according to MADD, Thanksgiving day was the deadliest Thursday of the year. A new trend called "Blackout Wednesday," where revelers drink an exorbitant amount of alcohol on the start of the long Thanksgiving weekend, has also increased drunk driving fatalities. During the Thanksgiving weekend in 2010, drunk driving accounted for 40 percent of highway deaths and 174 people were killed. This is up from 35 percent in 2008.
