NYC Subway Death Update: Suspect Naeem Davis questioned by police in alleged "fatal push"

(CBS) NEW YORK - New York City police have been questioning a suspect in the death of a 58-year-old man who was allegedly pushed onto subway tracks Monday and couldn't avoid an oncoming train.

CBS New York reported the suspect, identified as 30-year-old Naeem Davis, was spotted in Midtown Tuesday by detectives who recognized him from cell phone video of the moments leading up to the deadly incident.

No charges have yet been filed, according to Deputy Commissioner Paul Browne.

Ki-Suck Han, 58, of Elmhurst, Queens died Monday afternoon around 12:30 p.m. after being hit by a southbound Q train at the 49th Street Station, police said.

Police sought information from hundreds of riders at the subway station.

In smartphone video released by police, a man could be seen arguing with the victim, telling him "Take your [expletive] over there, stand on line, wait for the R train."

"We have a witness that says there was a shoving, or a push, depends on how you characterize it," police commissioner Ray Kelly said.

The victim hit the tracks, then tried to scramble back onto the platform, but was struck and killed by an approaching train.

A $12,000 reward was being offered in the case.

According to CBS New York, police are planning to have a lineup for witnesses to view the suspect later Tuesday and perhaps identify him as the culprit.

CBS single handedly got this man off the hook by posting that video.Who is to say if the witness was a little hazy on his looks, but now after seeing this video, picks this man just because they think this is the man police suspect who did it. Especially to avoid the embarrassment if they chose the wrong man its easier to go with video and say yup that's the guy.

I'm no lawyer, but unless they have some other proof besides witness testimony they may have a tough time proving the case. THANK YOU CBS.; Reply to this comment

by verysimplesimon December 4, 2012 7:45 PM EST: What ----- is wrong with ny subway system/ that train has no business rushing up to the plateform so fast heavy as it is with no ability to stop in time? what if a child broke loose from his parents and dashed around and fell in front of the thing? there should instantly be a rule that the 1 or 2 minutes saved by rushing up with NO no no no ability to quickly stop the heavy thing fast is over over. measure the speed and distance needed to stop at a moments notice and then come up to the platform area ONLY at THAT speed, any driver exceeding that instant manslaughter if anyone is killed by the train. this death of that poor man was inexcusable. the goon that did it shouldbe charged with as many charges as possible so he never gets out an irresponsible devil and heartless he knew that man would be hurt or killed why push him AT THE LAST MINUTE it was therefore premeditated! A life nightmarishly snuffed out for little or nothing I am ashamed that he had to be black like me! this kind of brutality gives us black people a very bad name execute or throw away the key
