Jerry Sandusky voicemails to "Victim 2" released by lawyers who plan to sue Penn State

(CBS/AP) A man who claims he was "Victim 2" - the boy assaulted in a Penn State shower by Jerry Sandusky - intends to sue the university for its "egregious and reckless conduct," his lawyers said Thursday.

The lawyers said in a statement they have gathered "overwhelming evidence" of the abuse, and they released recordings of two voicemails they say were from Sandusky last year, both saying "love you" to the victim.

The voicemails are dated Sept. 12 and Sept. 19, 2011, less than two months before the former assistant coach was arrested on child sex abuse charges.

The second voicemail asks whether Victim 2 would like to attend Penn State's next game.

Sandusky left "numerous" voicemails for their client in the fall of 2011, the attorneys said.

The statement from the attorneys said Victim 2 suffered "extensive sexual abuse over many years both before and after the 2001 incident."

In the recording of a pair of voicemails released with the statement and posted online by the lawyers, a voice that purportedly is Sandusky's expresses his love and says he wants to express his feelings "up front."

The identity of so-called Victim 2 has been a central mystery in the case. Jurors convicted Sandusky last month based largely on the testimony of former Penn State graduate assistant Mike McQueary, who described seeing the 2001 attack.

Sandusky awaits sentencing on 45 counts of child sex abuse. A scathing independent review has said several top Penn State officials looked the other way after complaints of his abuse because they were afraid of bad publicity.

"Our client has to live the rest of his life not only dealing with the effects of Sandusky's childhood sexual abuse, but also with the knowledge that many powerful adults, including those at the highest levels of Penn State, put their own interests and the interests of a child predator above their legal obligations to protect him," the attorneys' statement said.

The victim is not named.

The university said in a statement that it is taking the case seriously but cannot comment on pending litigation.

A call seeking comment from Sandusky's lawyer, Joe Amendola, was not immediately returned. A message seeking comment from the attorney general's office also was not immediately returned.

The voicemails are available to listen to on the website of Ross Feller Casey, LLP., the firm whose lawyers are representing Victim 2. The law firm did these transcriptions of the voicemails:

Sept. 12, 2011 voicemail:

"...Jere. Um. I am probably not going to be able to get a hold of anybody. Um. Uh. Probably ought to just go forward. Uh. I would be very firm and express my feelings, uh, upfront. Um. But, uh, you know, there is nothing really to hide so. Um. If you want, give me a call. You can call me on my other cell phone or on this one, either one so. Alright, take care. Love you. Uh. Hope you get this message. Thanks."

Sept. 19, 2011 voicemail:

"...Just calling to see you know whether you had any interest in going to the Penn State game this Saturday. Uh. If you could get back to me and let me know, uh, I would appreciate it and when you get this message, uh, give me a call and I hope to talk to you later. Thanks. I love you."

He is like the guys you date, or don't date, that are so clumsy and borderline (if not all the way) rapists - that still NEVER GET IT. They are completely oblivious of your repugnance and refuse to recognize resistance. They look at resistance as a game, if they ever recognize it. They are convinced you love them and that they are desirable to you. Anything short of an arrest warrant or atomic bomb will not stop them. They just DON'T GET IT. The man obviously wasn't rooted in reality, and had some childhood trauma that wasn't ever addressed. This is what happens when we turn our care of the psychology of the male out on its own whilst they are growing up. Why is everyone calling this man a monster, when at one time in his life he was someone's baby. Shouldn't we try to understand this rather than persecute it so that we can prevent it from happening again? Remember that this is a cycle of abuse.

by lloydbest1 July 27, 2012 9:12 AM EDT: Actually, no. What drove Sandusky started shortly after he was concieved; certainly long before he was born. This was not something that was created in infancy or early childhood but a congenital aberration. Adult sexual predation of minor children has nothing to do with abuse. It has nothing to do with poor home values. Has nothing to do with religious beliefs or lack thereof. It is not influenced by childhood injuries. It is not connected in any way to any sociological factors whatsoever.

This was purely Sandusky and no one else and nothing else did this to him.

Nearly all of us have our inborn failings and disabilities. The crosses we all bear are more onerous for some than for others. Compulsive behaviors (overconsumption of alcohol, drugs, etc; gambling; shopping - and various sexual proclivities) are among the most difficult to deal with and are totally incurable. You don't "fix" someone like Sandusky; you can't. The best one can do - and it's a big if - is keep 'em from getting worse over time. In a way, I feel for these people precisely because there is SO little that can be done.

There are alcoholics out there that never drink; compulsive gamblers who stay out of the casinos; druggies who get and stay clean - and I suspect, pedophiles who never touch little kids. Unfortunately they are in the minority. And in the case of pedophilia, you only have to fail once. In any case we need to do more to find out what allowed these few people to manage their pathologies sufficiently to live (nearly) normal lives.

I have to disagree with your belief in what made Sandusky the way he is. It's too late for Jerry, but I do believe that early diagnosis, intervention and treatment can rescue some of these people and in so doing, prevent or dramatically reduce the number of such incidents in the future.

The author of the article needs to do a lot of research before he writes again. Lets check that statement. First off there were only 3 charges Sandusky was found not guilty of. Can anyone guess what those charges were. Ding, Ding, Ding. They were the charges that Mcqueary accused him of. The jury did not believe his comments and neither should we. Lock up Sandusky and Mcqueary in the same cell. Mcqueary could have easily overpowered Sandusky in 2001. Instead he is a coward that needs to be banished.

It seems the red head failed to beat Sandusky within an inch of his life and getting that boy to the cops who could have a rape kit done at the hospital for evidence to convict Sandusky in 2001.


by MyaWoof July 27, 2012 2:31 PM EDT: The interesting thing here, is that a Jury did not believe McQueary who claims he witnessed "VICTIM 2" being molested by Jerry. The problem was they did not have an identifiable witness, well guess what folks. Here he is, victim 2 suing.

This is incorrect. Sandusky was ACQUITTED of the count involving Victim 2 and McQueary's testimony. He was convicted on 45 other counts involving other victims.; Reply to this comment
