College student studying criminal justice steals 79-cent doughnut, pays $200 fine

(CBS/AP) POWELL, Wyo. - A 19-year-old Northwest College student who is studying criminal justice has agreed to pay a $200 fine for allegedly stealing a 79-cent doughnut.

The Northwest Trail reports the student, Zach O'Dell, 19, was at a grocery store on Nov. 28 when a store manager supposedly saw him consume a single doughnut and leave without paying for it.

Attorney Sandra Kitchen told the publication that there will be no trial. The prosecution has been deferred and the defendant has agreed to the terms. The charge will be dismissed in six months if O'Dell stays out of trouble.

Kitchen says O'Dell has agreed to pay the $200 fine, $10 in court fees, and 79-cents in restitution.

Sources tell the Trail that O'Dell attempted to pay for the doughnut after being contacted by store personnel and claimed that forgetting to pay was simply an oversight.

Market owner Brent Foulger defended the charge saying, "paid for is OK; not paid for is shoplifting." He said this week that the store has a zero tolerance policy regarding theft.

O'Dell declined to comment.
