Judge to consider whether to declare Natalee Holloway dead

(Credit: Personal photo)(CBS/AP) BIRMINGHAM, Ala. - An Alabama judge has scheduled a hearing today to decide whether to sign a court order officially declaring Natalee Holloway dead.

Holloway, 18, went missing while on a school trip to Aruba in May 2005. A suspect in her disappearance, Joran van der Sloot, 24, pleaded guilty to the murder of 21-year-old Stephany Flores in Peru yesterday.
The hearing is at the request of Holloway's father, Dave Holloway. In September, Probate Judge Alan King ruled that Holloway had met the legal presumption of death for his daughter and that it was up to someone to prove she didn't die in Aruba.
Holloway's attorney, Mark White, says no new evidence has emerged.
