Police: No New Charges for Shaniya Davis' Death ...For Now

FAYETTEVILLE, N.C. (CBS/AP) Investigators handling the death of Shaniya Davis say they can't file any more charges until they decide where the crimes took place.

Fayetteville police had said they planned to file more charges in the death of the 5-year-old North Carolina girl whose body was found Monday beside a rural highway in Lee County, but Police Chief Tom Bergamine said Wednesday they won't file more charges until jurisdiction is determined.

Authorities are trying to decide where the girl was killed and if the case will be prosecuted in Lee County or neighboring Cumberland County, where she lived.

Police believe Shaniya's mother, Antoinette Davis, sold her child as a sex slave. She is charged with human trafficking and child abuse involving prostitution.

Mario McNeill is accused of kidnapping the girl after surveillance footage from a Lee County hotel showed him carrying her through a hallway and towards an elevator.

Shaniya was an angel with hidden wings. I was hoping for a better outcome. How could a mother not protect her child from something like this. Although I never met little Shaniya I can tell that she was a very happy child. Mr. Lockhart- May you keep those memories as your primary memory of Shaniya (your happy times with her). I hurt for you and your family. Find comfort in knowing that Shaniya knew that you loved her and that you were doing what you thought was best for her and allowing her to establish a relationship with her mother. I physically ache inside and cry out for comfort for anyone who ever has experienced this devastating loss. May God bless Mr. Lockhart and the family at this time. My prayers are with you. Everyone who speaks of Shaniya, although we have never met her says the same thing; Shaniya looks like a happy little angel..It is obvious that her daddy loved her.

I am devastated by this act of hatred; I am doing my best not to push or post judgement until the autopsy is complete and more details come out but, being the mother of a 5 year old too, I keep asking myself how could Shaniya's mother allow this to happen? Secondly, what man would want to have relations with a 5 year old? I hope all the details for this crime are relesed immediately and that those responsible for this terrible crime are given the death penality especially the mother if indeed she is responsible for this beautiful baby's death.

I don't think I've ever had more hate for 2 people in my life. If I was a juror in either of these trials- I would not be able to contain my self from jumping over the jury box and attacking these perverts. This is simply evil. Why are we wasting our tax dollars on fair trials. Where was Shaniya's fair trial? I say they don't deserve life!
