Lemonade Stand Shut Down by Food Inspectors; County Chair Apologizes

PORTLAND, Ore. (CBS/AP/KOIN) Jeff Cogen, the top elected official in Multnomah County, Ore. tried to turn lemons into lemonade, by apologizing Thursday for the shutting down of a lemonade stand by county health inspectors at a Portland arts fair last week.

"A lemonade stand is a classic iconic American kid thing to do," the county Chairman said. "I don't want to be in the business of shutting that down."

Cogen told CBS affiliate KOIN that he called Julie Murphy's mom and "shared with her my feeling that it really wasn't the county's business to be stopping 7-year-olds from selling lemonade."

He said she appreciated the apology.

"It's not necessarily best to have strict lines all the time," Cogen told KOIN, "and sometimes professional judgment and discretion needs to be used here." He's asked the health department to find a better way.

Cogen also says that he ran a lemonade stand, and his kids do, as well.

Maria Fife, Julie's mom, said her daughter wanted to open a lemonade stand after seeing a cartoon character open one. She was selling Kool-Aid lemonade for 50 cents a cup when an inspector approached and asked for her license - which costs $120 - at the fair. The other vendors reportedly rallied around Julie, and her "business" started booming.

According to KOIN, two inspectors then threatened Julie with a $500 fine, and she left in tears.

While the county inspectors were doing their job, Cogen said, the rules are meant for professional food service operators.

"This isn't something we need to be using our limited resources to crack down on," he said.

This video came out several months before a similar REAL event that CNN reported on. This is a case of life imitating art.

The film starred Jasmine Barrios, Paul Fahrenkopf, and Ed Taylor. There are two curse words in it, so caution is advised.

That is Crazy! How can adults be so narrow minded? It reminds me of drivers that are on the road alone, with a biker on the shoulder, and won't cross over the lines on the highway to make room for the cyclist! How tarded is that?

i can't believe the nerve of this 'woman'. ripping off the state revenue department. that in turn takes money from infrastructure, welfare checks, law enforcement etc... hang her!

you nimrod, this wasn't a lemonade stand in her front lawn. This lady drove her daughter 20 miles into the city to set up shop at an art fair that gets more traffic than the Blazer games. All the other vendors had licenses.

Perfect example of a couple of Nimrods who lack any "Common Sense"! ...its a rite of passage for kids to have a lemonaid or coolaid stand during the summer! these inspectors should have been slapped silly with their note books by bystanders.

sure it's lemonade today- but what if tomorrow this alleged 7 year old starts selling waldorf salad or sushi? if the health inspectors are not vigilantly crushing this sort of behavior disaster is sure to follow- mass tummy aches, overcrowded emergency rooms filled with aliens and illegal aliens. not to mention the price of this 'kool'
aid- 50 cents a cup? my god the rich just get richer! if our constitution allowed lemon aid stands you know our FOUNDING FATHERS would have said so. does it say "life liberty and the pursuit of lemonaid?" socialism! socialism! it's EXACTLY like what happened in the 1930s! we need to take back america - just like taking back a wrong sized sport coat. socialism. yes

"This isn't something we need to be using our LIMITED RESOURCES to crack down on," ?? yea right, only had two inspectors in the area. another blotted bureaucracy at work. The private sector in Oregon is in the dumps while government agencies just keep hiring.
