Texas Man Gets Death Penalty for Beheading 3 Kids Under the Age of Four

EDINBURG, Texas (CBS/AP/KGBT) A south Texas jury sentenced John Allen Rubio to death on Thursday, four days after convicting him of murder for beheading his common law wife's three children in 2003.

The jurors had deliberated for about four hours.

"I'm sorry it all had to come to this," Rubio said in an open court. "I thank the jury for giving me a chance to show what I could."

It was the second time the south Texas man has been sentenced to death for the slayings. He was convicted of killing the children all under the age of four - smothering, stabbing and ultimately decapitating them - in a windowless Brownsville apartment.

Gonzalez, who said he had sentenced more people to death than any judge in south Texas, said he recognized that a lot of people went through what Rubio did, citing his abusive and troubled childhood.

"I don't know what happened, but I know what this jury found," Gonzalez said. "I have never seen a crime like this."

Jurors on Monday found Rubio guilty on four counts of capital murder - one charge for each child and one for the children together.

Rubio was previously convicted of the murders in 2003 and sentenced to death. But a state appeals court overturned his conviction in 2007 because statements from the children's mother, Angela Camacho, were wrongly allowed as evidence during the trial. Camacho pleaded guilty and is serving a life sentence for her role in the slayings.

At his current trial, Rubio pleaded not guilty by reason of insanity, but the jury rejected that defense.

CBS affiliate KGBT reports that attorney Larry Warner, who will be representing Rubio in his appeal, says that Rubio's appeal of the verdict is automatic.

"The appeal is automatic, you don't even have to file the notice of appeal," said Warner. It could take, he said, four or five months for the case to reach the Texas Court of Criminal Appeals, and once there, the nine judges will determine if the conviction and sentence should stand.

Rubio attorney Ed Stapleton said the result saddened him.

"I've gotten to know this man over the last three years, so to think of him dying on a gurney is very difficult," Stapleton said. Texas executes by lethal injection.

"He misses those children more than anyone else alive," Stapleton said.

"I think there's a special place in hell for Mr. Rubio," said Cameron County prosecutor Charles Mattingly.

I don't understand why people are saying "what if this was your brother, or son, would you still say all the stuff about what should be done to him?" HELL YES!!! Those precious innocent babies had to suffer because their parent's were incredible low life pieces of ****! If this was my son or brother or whoever that did that to their kids then the only justice in my eyes would be a slow and painful death. Honestly if I could be the one that ends his life I would do it in ways people couldn't imagine..I would take my time and smile while I did it. Yes I may sound shallow but what these parents have done to their children is the lowest of the low...they deserve to rot in HELL!!!

** And as for Rubio's attorney, hell he should be fired for the way he thinks...it actually saddens him to think this murder is going to die? No, it saddens me because he get's lethal injection when he deserves way worse then this. No he does not need to rot in jail!! I will not pay taxes to shelter and feed this waste of a human being, off with his fu**ing head!!

I know that everyone is entitled to a legal defense under our system, but the lawyer does not need to extole the virtues of his client. The lawyer Stapleton should have kept his mouth shut and then we would not have known how much of a jerk that he is.

While I do not discount for a moment the horrific and unimaginable crime against these three innocent children, my comment concerns the lack of editing in this article. Who is "Gonzalez"? Obviously he or she is a judge, but what happened to identifying someone first before simply using their last name in a quote? I would expect better from CBS...

I think it's time to start paying people to have kids on other moons and planets. Once they're born on Earth, it's almost impossible to get them off, short of killing them off. Plus, we can't seem to outwit one another either. The best solution is to pay people (or give them incentives) to produce tons of children on other moons and planets. Be fruitful and multiply....throughout the Galaxy.

The only thing I have to do to know this man is getting what he deserves (not close) is, all I have to do is imagine the HORROR those babies,...babies that trusted those adults to protect them, imagine what they were going through as this man, and their mother, smothered, stabbed and beheaded them!

No, no mercy for him...justice for the pain and suffering of the children.

Screw him, think only of the CHILDREN!

God rest the souls of those children, may this man and their mother burn in hottest place in hell for all eternity!

I agree with Brownie. Some of these posts indicate that there are some very sick-minded people out there. Put Rubio in a cell by himself for the rest of his life. That, alone, is heavy retribution. As for all the draconian punishment some of you want to see meted out, imagine if your son, brother, father etc., was Rubio. Would you still want all the acts done to him that you're asking for Rubio? And telling yourself that your son, etc., would never do something like this - I'm sure Rubio's parents thought the same about their son.

I am against the death penalty - my right to my opinion. That said, I would have no problem putting this guy in Supermax, let him spend 23 hours alone in his cell, never see anyone but guards, let him have his next forty years to reflect on his crime; he'll have plenty of "downtime" to do that. Respectfully submitted.
