Saggy Pants: Not a Crime to Look Foolish

NEW YORK (CBS/WCBS/AP) Saggy pants, a crime?

"Not in the state of New York," Judge Ruben Franco told CBS affiliate WCBS. "In the state of New York there is no such law."

An NYPD officer recently gave a Bronx man a ticket for saggy pants, but Ruben tossed the offense, saying the ticket wasn't legal.

Judge Ruben Franco said that the summons appeared to be an attempt by one police officer to show his displeasure with the style.

Franco has ruled on many saggy pants cases in his courtroom and has made the same decision each time.

"We may find this mode of dress distasteful, but it's not illegal," Franco said, according to WCBS. "The constitution does permit for foolishness in people in their mode of dress."

The Bronx man, Julio Martinez, was issued the ticket on April 20. Franco's decision was issued last month.

It should be a crime! Indecent exposure at the very least. Who wants to walk behind someone with their business out for the world to see; and not to mention walking in front of them! A woman was walking with her little daughter and a guy was coming directly at them with his pants so low, you could see the imprint of his *****. The little girl's head was literally parallel to this man's ***** and his boxers were gaping open!
Wouldn't that qualify for indecent exposure?

just looks incredibly stupid. i almost wish they'd trip over a brack in the sidewalk and wipe out while i was watching, just so i could wag my finger at them and say, 'you see, THAT's why you're supposed to wear your pants on your a-ss doofus.'

This is all too funny. Years ago when I was new to Portland people would tell me that there were times in the history of the city when it was completely acceptable to walk around the town NUDE. I never witnessed this, but it demonstrated that just about anything was possible with humans! Personally, I think it a foolish fashion statement, not unlike women wearing 5" and 6" spiked heels. Hopefully neither group will have to run for their lives anytime soon.

Indecent exposure? What are you guys, like a hundred years old? I'm almost 50, and although I think its very distasteful, it's not indecent exposure, good God. Exactly what are they exposing? If that's your ill logic, then you better start arresting just about every plumber, gymnast, figure skater, and every person at the beach (who all expose more than these "pants on the ground" guy).

It's a good thing that this is still a free country. If you're not free to be foolish, you're not free. And it's clearly not indecent exposure, if a speedo is not.
