According to Roethlisberger's attorney, Ed Garland, the club's digital video recorder system recorded over the scenes captured on March 5 at the Capital City nightclub in Milledgeville, says CNN.
Police were able to see a small portion of the video, according to the attorney representing the nightclub, but were hoping to use the complete footage in their investigation reports the cable channel.
Garland said on Tuesday that the Georgia Bureau of Investigation withdrew its request for a DNA sample from Roethlisberger a week ago.
Bureau spokesman John Bankhead said Wednesday that it's not commenting on Garland's statement.
Milledgeville police Chief Woodrow Blue said Wednesday the investigation is ongoing, but also declined to comment on the status of a DNA-sample request.
Blue says investigators still hope to interview Roethlisberger.
Roethlisberger has not been charged, and Garland has disputed the assault claim and hired his own team to investigate.
