Key Provisions of the Senate Health Care Bill

5696255Senate Majority Leader Harry Reid unveiled his health care proposal "The Patient Protection and Affordable Care Act" on Wednesday night.

The Congressional Budget Office says the bill would cost $848 billion dollars over 10 years, reduce the deficit by $130 billion and would extend coverage to 94 percent of eligible Americans, reducing the number of uninsured individuals by 31 million leaving about 24 million people uninsured.

Here's a look at some of the key provisions of the bill:

• Effective Date 2014

• Requires most individuals to purchase coverage through their employer, privately or through a public plan. Includes exemptions for economic hardships. Fines for individuals not complying would start at $95 in 2014 phased-in over time up to $750.

• Creates a new public federal health insurance plan, the so-called "public option" which would compete with private insurers. States would have the choice of opting out by passing a state law.

• Establishes Health Insurance Exchanges, a marketplace where individuals, small businesses and others could purchase health care coverage.

• Insurance companies could not refuse coverage based on pre-existing condition. Would not allow higher premiums for pre-existing conditions or based on gender.

• Allows children to stay on their parents plan up to age 26.

• There's no employer mandate, but fines are paid by companies if the government subsidizes employees coverage.

• Extends tax credits to individuals and families earning up to 400 percent of the poverty level, on a sliding scale depending on income. On the low end of the scale Americans would pay no more than 2 percent of their income on premiums, rising to 9.8 percent at the high end of the scale.

• Forty percent Tax on high premium insurance plans, so-called "Cadillac" plans, those plans costing over $8,500 for individuals and $23,000 for families.

• Creates a new 5 percent tax on elective Cosmetic Surgery

• Increases Medicare payroll taxes by one-half percent to 1.95 percent for individuals earning more than $200,000 or couples earning more than $250,000.

• Limitations on Health flexible spending accounts, capping annual contributions at $2,500.

• Provides for one year additional $500 dollars for seniors before hitting the Medicare donut hole, but does not close the donut hole.

• Expands Medicaid program for low – income people from 100 percent of poverty level to 133 percent of poverty level.

• Immigrants in the country illegally would not receive health care subsidies, nor would they be able to obtain insurance through an insurance exchange.

Red-Pelosi bills Infringe on Bill of Rights> 3rd, 5th, 9th, 10th and 14th amendments!
Applies 9 new tax/fees; MANDATES WITHOUT MONEY to States on Medicaid shifting. Mandates signup and compels fines and even jailing offense. Denies small business opportunities to form associations for group-rating pools.

Senate Majority Leader Harry Reid (D-NV) released a merged version of the Senate comprehensive reform on 11/19/09, which Mike Oliphant whom manages Utah health insurance plans for www.benefitsmanager.net/utah-group-health-insurance.htm employers could get behind and support some of it (Patient Protection and Affordable Care Act, or H.R. 3590). This should encourage the private sector health insurance carriers to form INSURANCE EXCHANGES which is what we have done here in Utah. They carry the risk and burden, not the tax payer. The government wants to not only force a healthcare program that can't possibly achieve it's goals within the advertised costs, they also want to violate the entire premise of limited government. The Constitution delineates what the government can do, and nationalized health care is definitely outside it's legal authority. The very concept of requiring everyone to buy health insurance is best described as a betrayal of everything our founding fathers fought for. This requirement is NOT analogous to car insurance, many people don't drive and so don't have to buy car insurance; shall we force them to so everybody else's rates go down?

This is not a solution for the people of this country, it's a grab for power by the elite who want more control over people's lives. Big Brother is alive and well. While politicians say their intentions are good, my grandma used to point out that the road to hell is paved with good intentions.

a monthly abortion premium will be charged of all enrollees in the government-run health plan. It?s right there beginning on line 11, page 122, section 1303, under ?Actuarial Value of Optional Service Coverage.? The premium will be paid into a U.S. Treasury account ? and these federal funds will be used to pay for the abortion services.

IF this is the bill,where are the other 1999 pages and why did it take over 2000 pages to just state this? Some thing is missing here there is no way this could take over 2000 pages. What are they not telling us? Sounds like they want to cut Medicare and yet expand it to cover the un-covered? If this is all there is why are the congressional employees and unions exempt?

Mandated insurance purchase at a time when people's incomes are already being squeezed beyond ability to find the co-pay for an actual visit is stupid and will result in disaster for the democratic party. That's what happens when you fail to do the right thing, such as fight for and win universal health care.

You should read some articals about how the government wasted billions and billions of tax payer dollars every year. Why not clean that up first before spending trillion more? Talk about not thinking straight?

Why do people from all over the world come here for treatment, including heads of states and anyone that wants the best treatment money can buy?

Because it is the best health care money can buy. Nobody in the entire world has hospitals like the US.

Just in the past 6 years, 5 new hospitals have been built in the Akron, Ohio area within a 10 mile radius from us. Some of these emergency rooms have hard wood floors, never any lines, walk right up and get treated, no insurance required. The latest CT scanners and technology second to none anywhere in the World. This is Akron, Ohio one of the forgotten industrial capitals of the World. This is not a booming town.

The Republican party has not been in control for the last three decades, educate yourself.

The Republican party created tax free health savings accounts and the Democrat want to take them away, educate yourself.

The Republican party has wanted to do tort reform for the past two decades and the Democrats and lawyers have stopped it at every step. Any healthcare reform without tort reform is no reform, it's is lies and smoke screens, the cost will continue to rise, educate yourself.

The only thing the are ACTUALLY doing is taking over 1/6 of our economy. This is a socialist/Marx's move and will destroy the best healthcare in the world and will only hurt the poor.

There tyrant's acts will cost tax payers more and more every year. The taxes is the latest Senate bill are for ten years, the actually health coverage is only for 6 years. How about paying for a new car with payments for 10 years and you only get to use it for 6 years?

This Health Care Reform Bill is a major SMOKE SCREEN for the real problem. It is called bait and switch... The real problem is TORT REFORM.... You want to get a real reduction in the Medical Insurance Program as it stands right now... Get the lawyers out of your exam room, surgery room, drug store, dentist office and watch the premiums go down down down and doctors come back into the fold that were forced out because the lawyers have made it too expensive to provide the care we so badly need............

10,000Years, this tort reform gimmick has been completely debunked. It has failed in every state where it was implemented. It actually increased costs and all that was accomplished was taking away rights from patients. And it affects less than 2% of the costs involved with healthcare so how could this do anything significant at all to address the huge healthcare insurance problem? It can't. This is just another right-wing distraction/distortion to doesn't work to fix anything.

Tort reform is no gimmick and has never been debunked. 2% is only the cost of litigations, the other part is doctors testing to prevent lawsuits which you are not including in the costs. It has been tried in Texas where physicians have been leaving because of liability insurance (defensive medicine) and now they are coming back in droves because of tort reform. Without tort reform doctors will not practice certain medicines because of the liabilities. Why spend 16 years of school to be taken down by a lawyer without out any caring for the patient and stuffing his pockets full of money. It has worked and could work. The tort lawyer?s lobbyists are in the back pockets of Democrat politicians and won't allow it.

Maine, Tennessee and Massachusetts have all tried public options and they have all failed because of unintended/unseen costs.
