Abortion Rights Activists Decry House Bill They Say Attempts to Redefine Rape

Abortion rights activists are decrying the "No Taxpayer Funding for Abortion Act," a House bill that seeks to expand prohibitions regarding federal funding for abortions - and which opponents say attempts to redefine rape.

The bill (also known as H.R. 3) was introduced into the House last week by New Jersey Republican Chris Smith. It proposes making permanent some federal bans for abortion funding - including the Hyde Amendment, which prohibits health-care programs like Medicaid from covering abortions except in cases of rape, incest and danger to the mother's life. The Hyde Amendment is a provision that requires annual renewal by Congress that has been in place since 1976.

The "No Taxpayer Funding for Abortion Act," which currently has the support of 173 House members (including 10 Democrats), also prohibits employers and self-insured Americans from using tax breaks to buy private health insurance that covers abortion.

But the provision of H.R. 3 that has drawn the most widespread criticism from advocates of abortion rights is one regarding the exemption of pregnancies resulting from rape. The bill exempts a woman from the Hyde Amendment limitations only if she has become pregnant as the result of "forcible rape."

Critics argue that specifying the terms of rape as "forcible" in the legislation qualifies as a redefinition that excludes other forms of sexual assault - including statutory rape, which Mother Jones writes is often non-forcible.

In an interview with Hotsheet, Democratic Florida Congresswoman Debbie Wasserman Schulz called the bill "nothing short of a violent act against women." She equated denying federal funds to a rape victim with the "hijacking of a woman's independence."

"I don't know how anybody could suggest that there is any rape that is acceptable," she said. "I just think it sends a very clear message direct from the heart of the Republican party to women in America about exactly how Republicans feel about women."

Terry O'Neill, the president of the National Organization for Women (NOW), told Hotsheet she thought the bill was an attempt at "exposing women to the dangers of sexual assault after decades of efforts to stop it."

"It takes us right back to the 1950s, when women had to prove they were physically assaulted," she said.

Rep. Daniel Lipinski, one of the Democrats sponsoring H.R. 3, said in a statement it "was not intended to change existing law regarding taxpayer funding for abortion in cases of rape, nor is it expected that it would do so." (Rep. Smith did not respond to multiple requests for comment regarding the language of the bill.)

A representative for Lipinski told Hotsheet he would be open to removing the word "forcible" from the language of the bill.

Rep. Kevin McCarthy, a California Republican who co-sponsored the bill, told the Bakersfield Californian he expected the language of H.R. 3 would be revised in committee to reflect the Hyde Amendment's language that there are exceptions for all women who are raped - not necessarily only if it was deemed "forcible," he seemed to suggest. McCarthy said he himself would not offer that amendment, however, since he is not on the committee that will hear the bill. "But I'm sure we'll get to that point," McCarthy said.

Some defenders of the bill say that the outcry over the addition of the word "forcible" is being exaggerated, although Republicans and groups that oppose abortion rights have remained largely silent on the issue. The conservative Susan B. Anthony List, which aims to advance the voice of women in politics who oppose abortion rights, declined to comment on the matter, and multiple attempts by Hotsheet to reach Republican sponsors of the bill were not returned.

The irony of this issue is that 60% of abortions can be linked in some way to sexual abuse. This man wants to legalize the biggest reason women find themselves in a situation having to consider abuse. What is it with you men...legalized rape? Really? Do you think being with a 16 year old means you have tapped into the fountain of youth and somehow you are going to live longer? Or maybe you think raping teenagers makes a statement about your manhood. Forced sex is a statement all right - that you are less than human and that there is nothing manly about you. Want to stop abortions at any stage, stop sexual abuse (fyi, average of sexual abuse starts at 4) and sexual slavery (one of the fastest growing businesses in America) and sexual use of our young girls and women (porn, but the way, is abuse of women. Don't think so - ask your local prostitute, dancer, model, porn star how she got there...freedom of choice is not what you are going to hear as she tells her story.) Stop trying to control women and start controlling your sexual urges. You are in control of what you think and what you do guys, not the woman wearing the short skirts. Because if you don't think about having sex with her, which you have control of, then you won't have to think about raping her.

As a supporter of federal funding for any medical procedure - including abortions - I find this to be just another step back in our progress towards a functioning cooperative society. The (growing) poor in this country should not be treated as second-class citizens just because they can't afford to privatize their right to choose.

I have seen numerous posts citing the Hyde Amendment to a previous poster that complains about not wanting their tax dollars to pay for abortion. Please note, Hyde Amendment is restricting federal tax dollars to go towards abortion, not state tax dollars. So basically, if you live in California you don't have to pay for someone to have an abortion in Minnesota. It doesn't necessarily mean that you aren't paying for abortions (through your state taxes) in the state you reside, it all depends on your states constitution.

Regardless of pro-choice/life stance it really comes down to government control of our taxes. America was founded on the premise that each state should govern the area in which they live and not have one central government telling the entire country what they should do. (With the idea that people in CA live differently and have different needs than those say in Boston so each state/city should be able to vote for what is best for the area they live in)

I have worked in the media (newspaper) for 12 years and one thing I have learned is to read with caution, especially in the mainstream media. Everything you read these days has an agenda. To me they are turning this into pro-choice vs pro-life when really it more about whether or not we want to allow more tax dollars to be controlled at the national level. Sure, it may be about abortion funded tax dollars now but what issue will it be next, spray tanning, cosmetic surgery, tobacco, cell phones the list could go on.

The morality in the country is in the decline, TV and movies are all about sex, the educated and uneducated young adults have all been schooled on safe sex, no telling how much money is spent on it every year. If they all have these babies, welfare, foodstamps, low income housing etc. all continues to go through the roof. Might it not be cheaper for the government to hand out the abotion pill to these people that ahve no right having kids, and save us al the dime. Aids, and other STD are still on the rise and the taxpayers cannot afford to have the numbers continue to rise. These future kids affect the education system, healthcare system, and public safety because many of these kids turn out to be the future prison population.

This is not an issue of whether or not kids or adults unable to provide for their children, rather it is an issue of whether or not a woman should have the right to choose to have a baby that was a result of statutory rape, violent rape, or if the woman's health is in danger resulting from rape. (I hate to use the word rape because it has so many negative connotations and can sway the argument based simply on the use of this word.) In the end, it was the supreme court's decision to let the woman have the choice.

But let me make it clear that I do not support your views of the results of children that are born to low income families or parents will prove to be criminals, or that these children will lower the education system. Are these people supposed to be denied rights based on their financial situations?

Yes, I do also have three expections: rape, something serious wrong with the development of the baby, and of course if the mother was in danger. We should be given the right to choose, but I think that THE RIGHT TO GET AN ABORTION HAS BEEN ABUSED.Just like everything else... They're always someone who ruins things for other people. Don't be made at me for saying it... I never agreed with it, but it was a choice. I think it's WAY PASS THAT in this day and age.This day and age it seems like it's the new thing to do. I'm 20 years old (21 in 22 days) and I can't tell you how many girls I went to school with or even knew in my neiborhood that have had multiple abortions. One of these people is 22 Years old right now and she has already had FIVE!!! And this murder is still going around being "loose". It's to the point where I believe most of these "women" look at it as a birth control. It makes me sick... And mind you we're talking about 15 and 16 year olds at times. People need to keep their damn legs close if they don't want a baby... Or even better USE REAL BIRTH CONTROL. I don't care how you look at it, but to me these are REAL LIVE BABIES! IT'S MURDER!! It's that simple... Take away your excuses and your reasons. Bottom line it's murder, but I can see the three expections named above. If you think your ready to lie down and possibly make a baby, than your ready to take care of baby as well. That's what my house hold goes by. I wonder why I don't have any babies?! How in the world I made it with no babies with no ABORTIONS?!?!?! So I did the right thing. So why should my tax dollars pay for someone's "mistakes"? People need to realize that life isn't about do overs. These people who get these abortions need to TAKE RESPONSIABITY! Don't cry because you need someone to pay to kill your baby. I hope that all of you hate yourself when you look in the mirror you murders!!!!

So would you rather have government make that decision for them? No one takes the decision lightly. Unless you are in their shoes then you can not speak for them

And federal dollars are already not allowed to fund abortions per the Hyde ammendment, signed in 1976.

You can understand why they oppose this when you consider that some NOW members have declared that all sex is rape. The term "forcible" confines the descriptions of rape that would skirt the law. I find it amazing and disturbing that the liberals have such disdain for the sanctity of life!

So you are in favor of free, taxpayer funded abortions for anyone under the age of 18, and free taxpayer funded abortions for anyone who get gets drunk or high, screws someone and gets pregnant, and to think that people should pay for their own willful mistakes is despicable?
