Elena Kagan Nominated to the Supreme Court

Updated at 11 a.m. ET

President Obama today announced his nomination of Solicitor General Elena Kagan to the Supreme Court, calling her "one of the nation's foremost legal minds."

Kagan would be the fourth woman to sit on the Supreme Court if she is confirmed and the third woman to join the current Court. Mr. Obama called Kagan -- who is the nation's first female solicitor general and the first woman who served as dean of Harvard Law School -- a "trailblazing leader."

"She has won accolades from observers across the ideological spectrum," Mr. Obama said today, "not just for her intellect and record of achievement, but also for her temperament."

He praised her fair mindedness and her skill as a consensus builder, highlighting her effort as dean to bring more conservative scholars to Harvard.

"She believes, as I do, that exposure to a broad array of perspectives is the foundation not just for a sound legal education, but of a successful life in the law," Mr. Obama said.

The president also praised her passion for the law, which he called "anything but academic." Kagan's understanding of the law, Mr. Obama said, "not as an intellectual exercise or words on a page, but as it affects the lives of ordinary people, has animated every step of Elena's career."

He specifically cited Kagan's work defending the government's position in the Citizens United case before the Supreme Court last year, commenting that she "defended bipartisan campaign finance reform against special interests seeking to spend unlimited money to influence our elections."

Even though legal analysts rightly predicted the government would lose the case, Kagan chose to make it the first she argued as solicitor general.

"I think that says a great deal not just about Elena's tenacity but about her commitment to serving the American people," Mr. Obama said today.

Unlike all nine of the current Supreme Court justices, Kagan has no prior experience as a judge. Mr. Obama likely sees this as a strength, since she will bring a new perspective to the Court. Others, however, are wary of her lack of experience and the lack of evidence available to illuminate how she would serve as a Supreme Court Justice.

Her lack of experience is one of a few issues she will likely have to address during her confirmation hearings.

Defending the federal government's positions before the Supreme Court as solicitor general has given Kagan an "ever deeper and richer" appreciation of the value of that "extraordinary institution," she said today.

Mr. Obama urged the Senate to act in a "bipartisan fashion" and confirm Kagan to the Court "as swiftly as possible."

At just 50 years old, Kagan would be the youngest person on the Court, and she could serve for decades -- leaving Mr. Obama a lasting legacy on the Court.

Kagan would and has begun this effort long ago to support a structured system she and colleagues they theirselves hadn't and to this day will ever understand that they have become the flotsom on this mountain tide that will ebb and if I can help it not all of we or I on earth will be destroyed by this demonic implimentation of code soon to jar their every movements wherever they happen. This has already been seen through our eyes and C.B.S. with their affiliates like that of Viacom or M.T.V. Where to manufacture a lie which by nature another lie to layer until it is too late for all and these lies aren't alone. Kagan is the one. She will see it through that I receive once rehabilitated to see with full clarity the actions although not of my creation but of the machine we know as John P. The purpose for the nomination procedure and the lifetime term for Supreme Court justices was to take the politics out of it. By serving longer than any President, a justice was supposed to be free to decide cases on the merit of the law and not on any political agenda. Isn't it sad that over the years, this has totally changed? Today, the purpose for choosing a person and the process involved have become totally political. Elena Kagan seems to be just the latest and perhaps most blatant example of a President pushing an agenda on America.
Justices need to be impartial and experiences jurists who will interpret the Constitution fairly, honestly, and without bias. President Obama claims to be a Constitutional expert, so he should know that, shouldn't he? Perhaps his liberal agenda is more important than being objective!

Seriously? That's just childish. Someone disagrees with President Obama and they must be a racist - how does that help? All the person did was express their disapproval - you expressed hatred and ugliness. I voted for President Obama and I am disappointed with this appointment because the Supreme Court is not a place I want an activist with an agenda. I want someone who will strictly interpret the Constitution and constitutionally it's legal law, to not accept openly gay individuals. Subsequently, I hope this law is changed soon and I do disagree with it - but the lawmakers need to change the law, not a supreme court justice. I'm also disappointed with your lack of respect for others. Hatred and is hatred and it doesn't belong in the arena of debate.

Anyone who supports the military industrial complex to the detriment of the constitution has no business commenting on politics.

Well, we can all rest assured that the selection process this time around anyway most certainly was not a beauty contest.

She's really lucky! Lose a few pounds, wear high heals, get her hair and makeup styled and she'd look great. You, on the other hand, will be stupid for the remainder of your useless days. So sorry!

You would appear somewhat simple to base a decision on suitability for the job on such an issue.
