Samsung Galaxy Tab 10.1 pulled in Europe after Apple files suit

(CBS) - Sales of the Samsung Galaxy Tab 10.1 have been halted in Europe after Apple successfully sought a preliminary injunction from an EU court, claiming that the Android-powered tablet violates Apple's intellectual property rights. 

Apple has claimed that Samsung's Galaxy line of smart phones and tablets copies Apple design features - including the packaging and accessories. A judge in Dusseldorf agreed that the Samsung Galaxy Tab 10.1 copied elements of the iPad and so the device will be pulled from European store shelves. 

The device was released in the EU earlier this summer. It is still available in the Netherlands, but Apple is filing suit there, too.

Samsung says that they are "disappointed" by the injunction and "intend to act immediately to defend our intellectual property rights through the ongoing legal proceedings in Germany, and will continue to actively defend these rights throughout the world."

Apple filed suit in the US in April - requesting a jury trial in California - saying that Samsung had "slavishly" copied Apple designs. That case has not yet been resolved, and the Galaxy Tab 10.1 remains on sale in the United States.
