Memo offers new account of ATF agent's NY shooting
GARDEN CITY — A document accidentally posted on a New York prosecutor's website cites a pharmacist's version of the friendly fire shooting death of a federal agent during a robbery and differs from a version offered by an attorney for the retired police officer who fired the fatal shot.
The Long Island pharmacist claims the retired officer shot once without warning when he saw the New Year's Eve skirmish between the robbery suspect and the Bureau of Alcohol, Tobacco, Firearms and Explosives agent outside the pharmacy.
The retired officer's lawyer has said his client fired only after a shot whizzed past his head. The lawyer told Newsday on Wednesday it's not unusual for witnesses to have different accounts of an event.
The document was obtained by WINS Radio and Newsday before it was removed.
