House charges Holder with contempt of Congress

Updated 5:35 p.m. ET

(CBS News) The House of Representatives voted to hold Attorney General Eric Holder in contempt of Congress Thursday for failing to provide documents relating to the Fast and Furious gunwalking program.

The House took two votes, one on criminal contempt charges, which passed 255-67. The criminal contempt of Congress is likely not to go anywhere as the Justice Department, which Holder heads, is the department responsible for opening a criminal investigation.

The second charge, which passed 258 - 95, was a civil contempt charge, could move to federal court where it could take years to litigate. Though the action puts more pressure on the administration to abide by the subpoenas and provide requested documents.

The Democratic Party was split on the action. Seventeen members voted with the Republicans to hold Holder in criminal contempt while just under two dozen voted to hold him in civil contempt. But most, led by the Congressional Black Caucus, walked off the floor to protest the vote, which they called "appalling."

Attorney General Eric Holder reacted after the first vote, criticizing House Republicans for "making reckless charges" and "advancing truly absurd conspiracy theories."

He called the vote against him "a regrettable culmination of what became a misguided - and politically motivated - investigation during an election year. By advancing it over the past year and a half, Congressman Issa and others have focused on politics over public safety."

White House communications director Dan Pfeiffer said gunwalking dated back to President George W. Bush's administration and was stopped by Holder. "Yet, Republicans pushed for political theater rather than legitimate Congressional oversight."

"Unfortunately, a politically-motivated agenda prevailed and instead of engaging with the President in efforts to create jobs and grow the economy, today we saw the House of Representatives perform a transparently political stunt," Pfeiffer said in a statement.

Rep. Darrell Issa, Chair of the House Oversight and Government Reform Committee, which led the investigation, defended the contempt vote, saying "the Congressional inquiry into Operation Fast and Furious, and the cover-up by Justice Department officials of wrongdoing, has been a fair and fact based investigation."

"This was not the outcome I had sought and it could have been avoided had Attorney General Holder actually produced the subpoenaed documents he said he could provide," Issa said.

The contempt does not address the controversial Bureau of Alcohol, Tobacco and Firearms' Fast and Furious operation itself, which allowed more than 2,000 weapons to fall into the hands of suspected traffickers for Mexican drug cartels and where at least one gun was found at the murder scene of U.S. border patrol agent Brian Terry. Instead, it is about subpoenaed documents the Justice Department is withholding from Congress in the investigation.

Holder has testified before Congress nine times and turned over thousands of pages of documents. But Republicans investigating the scandal say the answers to many outstanding questions could lie in tens of thousands of pages of documents the Justice Department has failed to turn over citing that they're part of the internal deliberative process or ongoing investigations.

Several weeks of closed door discussions between members of Congress, their staff, Justice Department officials and even Holder himself resulted in a stalemate. President Obama granted Holder's request for executive privilege to keep the documents from Congress, but House Republicans question if the action is further evidence of a cover up.

The Justice Department had offered to provide a "fair compilation" of the outstanding documents if Republicans on the House Oversight Committee would agree -- in advance -- to end their investigation once and for all. Republicans balked when the Justice Department refused to provide a log of the withheld documents and descriptions of why they were being held back, as routinely required in court disputes of this nature.

I have several comments:

' ...the action puts more pressure on the administration to abide by the subpoenas and provide requested documents. ' -- Oh, is that like a UN resolution? You know, the kind of thing that hasn't stopped Assad from killing more of his own people or stopped NK or Iran from continuing to develop nukes? Fun.

' But most, led by the Congressional Black Caucus, walked off the floor to protest the vote, which they called "appalling." ' -- Ah, so now it's a "white massa hate us po blacks" thing? Anybody notice that if Holder's hair wasn't frizzy, he'd be a white man?

' White House communications director Dan Pfeiffer said gunwalking dated back to President George W. Bush's administration and was stopped by Holder. "Yet, Republicans pushed for political theater rather than legitimate Congressional oversight." ' -- Republicans aren't blaming Holder for Fast and Furious (yet); they're simply asking for documents. The truth, whatever it is, is in those documents.

' "Unfortunately, a politically-motivated agenda prevailed and instead of engaging with the President in efforts to create jobs and grow the economy, today we saw the House of Representatives perform a transparently political stunt," Pfeiffer said in a statement. ' -- *Somebody's* head needs to roll over this, whomever is responsible. An American border patrol guard died from one of these guns, and many Mexicans have been murdered by them.

' The contempt does not address the controversial Bureau of Alcohol, Tobacco and Firearms' Fast and Furious operation itself, which allowed more than 2,000 weapons to fall into the hands of suspected traffickers for Mexican drug cartels and where at least one gun was found at the murder scene of U.S. border patrol agent Brian Terry. Instead, it is about subpoenaed documents the Justice Department is withholding from Congress in the investigation. ' -- Thank you, cbsnews!

' Several weeks of closed door discussions between members of Congress, their staff, Justice Department officials and even Holder himself resulted in a stalemate. President Obama granted Holder's request for executive privilege to keep the documents from Congress, but House Republicans question if the action is further evidence of a cover up. ' -- Yes, of course it is!

Bush was responsible for the Fast and Furious program that was inherited by Holder.
Perhaps the Terry family could camp out at the ranch in Crawford.
That always works.
_______________________________________

That would be incorrect. The program started under Bush and was continued under Obama/Holder. They could have stopped it but didn't. That makes them (and Bush) severally responsible (look up severally if you don't know what that means).

You can't blame Bush without also blaming Obama. But thank you for indicting Obama for us.

Well, it is refreshing to see that there were 20+ intellectally honest members of the Democrat Party that want to see justice done for the familys of those killed (both Mexican and American) because of this program.

Attendees at the January Consumer Electronics Show in Las Vegas may have been confused when they ran into Darrell Issa: Were they meeting the California Republican Congressman and new chairman of the House Oversight and Government Reform Committee? Or were they meeting the board member of a private company Issa founded called DEI Holdings Inc.?
Issa declared he was there as a board member on personal business, and therefore exempt from House ethics rules governing travel provided to Members by outside parties. But his press secretary, standing next to him, declared he was there on official Oversight Committee business, and the Committee paid his way.

But they won't because Issa is a coward and Issa knows that he is basing all this on nothing....

The New Yorker's Ryan Lizza reports.
Issa has been accused, among other things, of stealing a car, carrying a concealed weapon, leaving the scene of an accident, firing an employee by showing him a gun, and burning down a building, as Lizza explains. The California congressman says he's innocent of all of these charges, and that, in several instances, it was his brother's fault. And he's tired of answering questions about them. "Everyone has a past," Issa told Lizza.

Contempt is too good for Holder. Holder was the scumbag that took the bribe/campaign donations for the Marc Rich pardon. Holder allowed the drug cartels to illegally purchase weapons so he could justify more gun control laws. Even Democrats are throwing this idiot under the bus since the NRA got involved. He can go now, or in a few months when Romney kicks his crooked a$$ out the door. But thankfully, his place in history is now assured.

And, Chris Christie worked for Ashcroft on the justification for torturing 800 detainees who were released 5 years later because they were innocent.
