Police in legal minefield on Ariz. immigration law

(AP) PHOENIX - More than two years after it was signed into law, the most contentious part of Arizona's landmark immigration legislation is expected to go into effect following a federal court ruling issue late Wednesday.

But the U.S. Supreme Court laid a legal minefield that Arizona now must navigate when the critical provision takes effect. The clause, one of the few significant ones that the high court left standing in a June ruling, requires all Arizona police officers to check the immigration status of people they stop while enforcing other laws and suspect are in the country illegally.

While preserving that requirement, however, the Supreme Court explicitly left the door open to arguments that the law leads to civil rights violations. Attorneys would need actual victims to make that case.

Civil rights activists are preparing to scour the state for such victims. Lydia Guzman, who runs Respect/Respeto, a Phoenix group that tracks racial profiling, said volunteers at the organization's call center have already been told to listen for new complaints when the requirement goes into effect.

"We're watching and we're looking for cases," she said.

Barring a successful, emergency challenge of Wednesday's ruling to an appeals court — an outcome that legal observers believe is unlikely — the requirement is expected to go into effect in the next several days. U.S. District Judge Susan Bolton rejected arguments by civil rights attorneys that she should prevent the requirement from kicking in, noting that the Supreme Court had specifically found that the provision should be allowed to become law.

Arizona police were formally trained on how to implement the law shortly after Gov. Jan Brewer signed it in 2010. The heads of some of the state's biggest law enforcement agencies — the Phoenix and Tucson police departments and the Pima County sheriff's office — were critical of it but ultimately said they would obey whatever parts the courts found to be constitutional.

"We enforce laws passed by our legislators," Sgt. Tommy Thompson, a Phoenix Police spokesman, said Wednesday night, noting the requirement still has not gone into effect.

Maricopa County Sheriff Joe Arpaio, who has been the most publicly aggressive in pursuing illegal immigrants, said in an interview Wednesday that his deputies already check the immigration status of people they encounter. Arpaio, a supporter of the law, said he expects no differences other than an increased number of lawsuits.

The law's author, former state Sen. Russell Pearce, said he does not expect sweeping changes in the way local police will conduct themselves once the requirement kicks in.

"I'm not asking for roundups, I'm not asking for anything but paying attention and doing your job," he said. "It's not that we want people in jail. We want compliance."

Peter Spiro, a Temple University law professor who has followed the two-year legal battle, said Arizona remains in a difficult legal spot.

"If the state's savvy at all, it's going to be very cautious" about how it implements the requirement, he said. "To the extent that it's not, it's going to be very vulnerable on this.

"Further litigation," Spiro said, "is imminent."

Since it overwhelmingly passed Arizona's Republican-controlled Legislature in 2010, the immigration law has been fiercely challenged in court.

Among its opponents was the Obama administration, which challenged the law based on the argument that federal immigration law trumped Arizona law. The challenge didn't confront racial profiling, and the administration failed to persuade the nation's highest court to strike down the questioning requirement.

I seem to recall the first person they hauled in, when this started and before the court challenge, was an American born truck driver from San Jose, CA. His wife had to drive out with his birth certificate.

Just for luck she brought hers along also.

Best bet for the Arizona Police would be to ask everyone they stop, white, brown or yellow for papers and haul in everyone who does not have them.

That would certainly be the quickest way to get the issue resolved....but you are putting the officers in a bad position. There will be push back when mistakes are made.

In November I am not voting for Obama, but not particularly happy with Romney either. I joined the Constitutional TEA PARTY, as they are for the self reliance, free fair commercial enterprise, reduction of government to the limits as written by our forefathers. Resume drilling for oil, natural gas and reopening the coal mines, with emphasis on not only clean coal production, but further research into new energy sources.

It's not so much the illegal alien invaders that is the problem, it's the fact we have to pay for them through state forced unfunded mandates of the court. The biggest issue is the majority Democratic states with poorly supervised election stations, will turn a blind eye to non citizens voting. I am not going to tell you about the terrible consequences of the democrats passing another mass amnesty, even after we were promised that no blanket amnesty would ever be enacted again. But neither do I trust the Republicans to carry out the full pledge of the issues involved. Only the rapid absorption of the TEA PARTY LEADERSHIP into GOP does the chance of America resurfacing under the weight of this depressed economy and jobs.

Actually the only issue I disagree with President Obama on is the one regarding illegal immigration. I think any "special" exceptions, no matter what the reason, that are made for those in our country illegally are an INSULT to those wonderful immigrants who entered and stayed in our country LEGALLY. That being said, I will gladly relinquish my own feelings on that subject and happily vote for Obama again because I really cannot stand the thougt of our country going on the Romney/Ryan Road to RUIN. The "protect" the wealthy because they are our "job creators" way of thinking is just bogus. It has never worked in the past and will not work in the future. I will not vote for the virtual elimination of the middle class and that is just what would happen if the Republican candidates made it to the White House. As far as the Tea Party goes, well they ARE the American Taliban and those wackos need to be eliminated altogether!

President Obama is deep in the pockets of radical environmentalist, who are cutting us of regular fuels. You have seen the $4.00 rise of gas at the pumps, when 4 years ago it was just a $1.49. Shrink the mammoth burdensome U.S. government; closing many and merging agencies. Start from scratch a fair and equitable tax code; no more immunity for corporations and friends of politicians. Stop Obama from giving more power to the United Nations and international courts. Realize that America is heading towards insolvency, if we don't get welfare programs under control, especially the (113 Billion annually and climbing) one hundred thirteen billion dollars going to subsidize illegal foreigners. The TEA PARTY will let free trade succeed, but will sanction countries as China who are manipulating their coinage and cheating us. We cannot trust the Democrats who remain deliberately unconcerned with non-citizens voting. Both parties refuse to enact mandatory E-Verify (H.R. 2885), to expel illegal aliens from businesses, and a Birthright Citizenship law (H.R. 140), that allows a projected 400.000 babies a year who gain citizenship, without a parent holding U.S. citizenship status. ONLY BY REPLACING THE SENATE AND HOUSE INCUMBENTS WITH HONEST, SINCERE AND ABOVE ALL ELSE TEA PARTY LEADERSHIP WITH BACKBONE, SUCH AS TED CRUZ OF TEXAS, RICHARD MOURDOCK OF INDIANA.

Any one asked for ID should show it, how hard is it to show your id. When asked for id to purchase items, like beer, porn, cigarettes,. when being pulled over for a traffic violation. Unless you have something to hide get over it, Or maybe you should just get deported until you become legal. Of course the country they are being deported to should foot the bill. Maybe then they will try to keep illegals from border jumping. WHEN IT COST MONEY IS WHEN YOU WAKE UP.

The real answer here is a simple one. The police can be at ALL Voting areas and at the exit check all ID's. That does not prevent voting but sure will drive off the illegals or fraud voters who could be taken into custody at that point.

I suspect the police have some real crime to attend to while voting is going on. This isn't a reality-based solution, unless your only concern in life is the phantom crime of voter fraud.
