10 ICE agents sue over Obama immigration policy

(CBS/AP) DALLAS - Ten federal immigration agents sued the Obama administration Thursday in Dallas over a controversial plan not to deport certain illegal immigrants, CBS Dallas station KTVT-TV reports.
The lawsuit accuses Homeland Security Secretary Janet Napolitano of violating federal law.
The agents claim Napolitano did not have the authority this past June to stop deporting illegal immigrants who came to this country as children and meet certain conditions.
One of the attorneys representing the Immigration and Customs Enforcement agents, Kris Kobach, is an informal adviser to Republican presidential candidate Mitt Romney.
"It places ICE agents in an untenable position where their political superiors are ordering them to violate federal law," Kobach said of the policy to The Associated Press. "If they follow federal law, they will be disciplined by their superiors."
Last week, thousands of young illegal immigrants lined up at consulate offices so they could apply for a two-year work permit to avoid being deported. The Pew Hispanic Center estimates 1.7 million people may be covered under this new directive.

In their lawsuit, the agents claim if they follow the new procedure, they will violate their oath of office and federal law. They want a federal judge to intervene.
A Homeland Security Department spokesman said the department is using its discretion properly.
The former U.S. attorney in Dallas, Richard Roper, said Napolitano could make a compelling argument in court.
"'We can't go after every illegal alien in the country,'" he said Napolitano could argue. "'We have to allocate and deploy our scarce resources in a certain way to try to address that, and I'm making that call and I have that authority.'"
Roper believes a federal judge will not intervene in the case.

While many point out that President Reagan provided "amnesty", it was still done WITHIN THE LAW. If you do not like the current law, CHANGE IT!!!! If there are not enough people to change it, then it is obviously not necessary.
Illegal is illegal. WHile I am willing to admit that there should be some sort of deal made in the case of children that did not know any better being brought over by their parents, many of the "children" that the administration is providing "amnesty" are NOT children. When you throw in the fact that the federal government is INTENTIONALLY performing illegal activities, this becomes unacceptable. (For those that think it is fine, how will you feel when they decide not to uphold the law in something that involves you personally????)
The federal government needs to FOLLOW THE LAW and uphold their oaths... otherwise we are bound down a slippery slope that will mean government only has to do what it wants whenever it wants and as often as it wants and there will be nothing anyone can do short of revolution to change it!

"More people are going back to Mexico from the United States than coming here from Mexico," says D'Vera Cohn, a senior writer at the institute and one of the report's authors. "This seems to be the first decrease since the Mexican immigration wave started in the 1970s."
The Mexican population in the United States peaked at a net 12.6 million in 2007. By 2011, it had fallen to 12 million.
The report analyzed data from five Mexican government sources and four US government sources, including census records and community and population surveys from both countries. Its finding: The net decline in the Mexican immigrant population is almost entirely driven by a decline in the number of illegal immigrants entering the US. The number of legal immigrants from Mexico has stayed the same.
Mexicans make up about 58 percent of an estimated 11.2 million unauthorized immigrants in the United States. Nearly 40 million immigrants - legal and illegal - live in the US, and Mexicans account for 30 percent of that total.
The standstill in Mexican immigration seems to be a result of the weakened US economy in which jobs are harder to find, heightened border control, greater danger crossing the border illegally, and a rise in deportations. Other factors include an improved Mexican economy and a decline in birthrates in Mexico.
"There has been a decrease in apprehensions at the border, which points to the fact that fewer people are crossing the border," says Pew's Ms. Cohn.
In 2005, more than 1 million Mexicans were taken into custody trying to cross the US border. By 2011, that number decreased by more than 70 percent.
Meanwhile, deportations of illegal Mexican immigrants have jumped sharply. In 2010, nearly 400,000 unauthorized immigrants were deported - 73 percent of them Mexicans.
Although many Mexican immigrants who have been deported say they plan to try to return to the US, a rising share say they won't.
A survey by Mexican authorities found that 20 percent of repatriated labor migrants said they would not return to the US in 2010, as opposed to just 7 percent who said the same thing in 2005, according to the Pew study.
