Fla. mom gets 20 years for firing warning shots

(CBS News) JACKSONVILLE, Fla. - A Florida woman who fired warning shots against her allegedly abusive husband has been sentenced to 20 years in prison.

Marissa Alexander of Jacksonville had said the state's "Stand Your Ground" law should apply to her because she was defending herself against her allegedly abusive husband when she fired warning shots inside her home in August 2010. She told police it was to escape a brutal beating by her husband, against whom she had already taken out a protective order.

CBS Affiliate WETV reports that Circuit Court Judge James Daniel handed down the sentence Friday.

Under Florida's mandatory minimum sentencing requirements Alexander could receive a lesser sentence, even though she has never been in trouble with the law before. Judge Daniel said the law did not allow for extenuating or mitigating circumstances to reduce the sentence below the 20-year minimum.

"I really was crying in there," Marissa's 11-year-old daughter told WETV. "I didn't want to cry in court, but I just really feel hurt. I don't think this should have been happening."

Alexander was convicted of attempted murder after she rejected a plea deal for a three-year prison sentence. She said she did not believe she did anything wrong.

She was recently denied a new trial after appealing to the judge to reconsider her case based on Florida's controversial "Stand Your Ground" law. The law states that the victim of a crime does not have to attempt to run for safety and can immediately retaliate in self-defense.

Alexander's attorney said she was clearly defending herself and should not have to spend the next two decades behind bars.

Alexander's case has drawn support from domestic abuse advocates - and comparison to the case of neighborhood watch volunteer George Zimmerman, who has claimed a "Stand Your Ground" defense in his fatal shooting of Florida teenager Trayvon Martin.

Her action was stupid and if she had of shot and killed him she would have walked but no she had to fire a "warning shot". If she was as afraid as she claimed she should have shot him dead.

So you are saying because she fired a warning shot/s, she wasn't afraid? - Opinions are invalid when sentencing someone to 20 years.

If someone is afraid, and can't bring themselves to kill another human being, you consider that person stupid?
You are deranged.
Not everyone is O.K. with killing people, nor should they be.

Frolin- No. Under the law you only use deadly force to protect yourself from immediate death or grave bodily harm. "Warning shots" are not covered under the law. I'm sure she was plenty scared...but not scared enough to shoot the guy? Maybe she was just mad at him? Who really knows? She should have taken the plea deal.

Did you read the article? She turned down a deal for three years...which I suspect would have been reduced to probation on appeal. I suspect she had a cruddy lawyer.

NolaJohn: Maybe she heard of Sarah McKinley who blew the heads off two men and praised as a hero. She killed two men and was never even arrested. Marissa neutralized the situation without spilling a drop of blood. Not everyone has blood lust. This was clearly self defense, a man with history of abuse violating a restraining order attacks her and she cares him off without spilling a drop of blood. She shouldn't have been on trial anyway, Sarah McKinley wasn't.. Then again Sarah McKinley is white.

Because white people can shoot and kill people, claim self defense and not even get arrested. A black mother neutralizes an abusive situation without hurting anyone and she the law changes. Have you ever heard of a white woman going to prison for defending herself from an attacker without even hurting him?

He's an idiot and made his judgement COMPLETELY OPPOSITE of what the "Stand your ground" law says. And besides............NO ONE GOT HURT!!!!
This is one stupid or incompetent judge OR.................one must consider who this article was written by.
I can't believe what has happened is based on this article. If it is true.....the judge should be removed and ALL his past judgements MUST BE LOOKED INTO!!!!!!!!!!!!!!!!!!!!!

I bet most Americans don't know that Florida fell into US hands when they agreed NOT to claim any part of Texas. 25 years later Texas was named a state when all others had to become territories first, and wait the required 10 years before applying for statehood....
As for this case, the judge should be shot under "stand your ground".
Florida law is corrupted as are the politicians, businesses, and many of its' people.
