Students sue over pepper-spraying at UC Davis

SAN FRANCISCO - The University of California, Davis is facing a federal lawsuit filed by students who were pepper-sprayed during a campus crackdown on Occupy protests last fall.

Nineteen students and alumni represented by the American Civil Liberties Union filed the complaint in U.S. District Court in Sacramento on Wednesday.

The lawsuit is the latest fallout from the Nov. 18 incident, when campus police doused pepper-spray on sitting protesters who had set up an Occupy camp.

Widely viewed online videos of the pepper-spraying generated national outrage and calls for the chancellor's resignation. The chancellor, P.B. Katehi, has apologized but refused to step down.

The lawsuit claims the university violated the demonstrators' constitutional rights and seeks campus policies to prevent similar responses to non-violent protests, as well as unspecified damages.

UC Davis officials declined to comment Wednesday because they had not seen the lawsuit.

Prosecutors said last month that none of the students involved in the protest would be charged. Yolo County District Attorney Jeff Reisig said there was insufficient information in police reports of the Nov. 18 protest to warrant charges against eight men and two women who were cited for unlawful assembly, failure to disperse or illegal camping.

The district attorney's office has been investigating the spraying at the chancellor's request.

I think it should be pointed out that Fox news is a very good news outlet. Completely fair and balanced. I don't know where the libs get their news, but Fox seems to be the most objective to me. As far as Rush is concerned, I find him to be extremely articulate as well as being right on target with almost every issue. If Rush were running for office, I would certainly vote for him. He is obviously far more intelligent than any Dumbocrat out there. In closing, I would like to say, do America a favor, VOTE REPUBLICAN!!! Anything is better than Nobama!

This isn't the first study that has found that Fox News viewers more misinformed in comparison to others. Last year, a study from the University of Maryland found that Fox News viewers were more likely to believe false information about politics.

It was a peaceful protest that the cops used for assaulting the students, the D.A. dropped ALL the charges against the students, and now the students will have their day in federal court, and WIN!

Good for the students..the constitution STATES the students HAD a right to PEACEFULLY protest..

..and the FACIST cops were just SHOWING OUT as some sort of video game hero.. to use pepper spray was accessive FORCE to intentionally inflict HARM for NO REASON by the COPS..

..if the students are in violation-- you arrest them..you picked them up and put them in the wagon.. NOT SPRAY pepper on them who aren't physically resisting the cops..

There's an growing legal assault on americans and their rights given by the constitution.

Yes pete, I also see those posts every day from the DENIERS, even though they are posting word for word fox/rush propaganda.

In this case, every last one of them posts the same exact drivel like it was a forwarded e-mail directly from hannity or rush, attacking the students for their non-violent protest and exonerating the cops for their outright assault.

None of the right-wing extremists could explain why the D.A. dropped ALL the original charges against the students, if they indeed were so guilty of numerous "criminal" acts, as the fox/rush parrots vociferously attacked them for......NONE!

NeoCon, you might find this link instructive. It's the relevant case law--a 9th Circuit Court of Appeals decision specifying that using pepper spray on nonviolent protesters is excessive force and violates their Constitutional rights. This is the precedent the judge will be looking at.
