Son's gift to 98-year-old mom: Eviction papers

FAIRFIELD, Conn. - A woman whose son served her with eviction papers on her 98th birthday two months ago is fighting his efforts to remove her from her home.

Mary Kantorowski has lived in her yellow, Cape Cod-style home in Fairfield since 1953. Her oldest son, 71-year-old Peter Kantorowski of Trumbull, says he's concerned about his her well-being. When he last saw her eight months ago, she seemed disoriented and was living in poor conditions, he said.

Peter Kantorowski, who owns the house, says his mother has rejected his suggestions to live with him or in a nursing home. A trial is set to being March 2 in Bridgeport Superior Court.

The eviction attempt has led to bad blood among family members.

"I didn't think he would do it," Mary Kantorowski said. "My husband worked hard, difficult jobs to buy this house. He built the garage and did a lot of work on the house and he told me never to leave it."

Her husband, John, died in 1997.

"This is just a despicable situation," her lawyer, Richard Bortolot Jr., told the Connecticut Post. "Mary has been living here happily paying all the expenses for the house and now her son, Peter, comes along and is telling her, `Get the hell out,' so he can sell it."

Mary Kantorowski's other son, Jack Kantorowski, told WTNH-TV: "There are no other words to call him. He's just a scumbag."

Bortolot says a probate court stopped Peter Kantorowski from trying to sell the house after the eviction papers were served on his mother in December.

Peter Kantorowski says he's just looking out for his mother's best interests.

"I'm not throwing her on the street," he said. "At her age, at 98, I'm sure that she should be with people of her peers. She should have her meals on time."

My name is Kevin Kantorowski and I am writing you to clarify events that have occurred and have not been

truthfully portrayed. I flew into Connecticut from Florida in Auguest, due to my brother's death. I

stopped by to see my grandmother and was appalled to see her living conditions. There was no food in the

refrigerator other than a can of soda with a straw in it and a loaf of bread, smoking in the house (when there

is a sign that state no smoking .......oxygen in the house), and the TV. that was in her room was removed

and subsequently put in Jack's room. Furthermore, there was no phone by her bed, incase of an emergency,

and there were newspapers scattered all over her floor. When I asked by grandmother why she had

newspapers all over the floor, she replied " In case I don't make it to the bathroom". I asked my grandma

where Jack was and she stated at his girlfriends house/ shed.
I turned to my father, who was present with me at my grandmother's house, and asked him "what was going on"? He stated Jack is suppose to be taking care of mom. He went on to state that Jack took the key and wouldn't allow ANY family members in the house. I told my father I see why Jack doesn't want any of us around....... The house is filthy and grandma isn't being looked after properly! My father and I then decided to go through grandma's bills and noticed the bills were getting paid .We also noticed several checks were written to liquor stores and gas for his girlfriend, Judy Byman's, car. In addition, there were several credit cards taken out in my grandmother, Mary's name, as well as in my Uncle Jack's name with my grandmother co-signer. These credit cards have been racked up in the sum of over 60 thousand dollars. Due to this, there are several lawsuits against my 98 year old grandmother.
My father took it upon himself to close out my grandmother's checking account , open up a new one and not allow Jack access to it. This made Jack and his girlfriend Judy angry.By the way Judy byman has a criminal record for stealing its, public record, Judy called SSI and had my grandmother monies frozen. How she was able to do that is beyond me!!!! My father brought Jack to probate court where Judge Daniel Caruso went over the evidence and asked my 98 year old grandmother, "Hey Mary how do you like to drink that cheap booze"? Judge Caruso then asked Peter to take over his mothers bills and to be her conservator. Peter declined, due to not wanting to deal with Jack, who's a drunk. Therefore, Judge Caruso appointed a conservator who's an attorney named Richard Bortoloc to handle the case. In the mean time, Judge Caruso asked Peter to continue to pay Mary's bills until Bortoloc can get this under control. He then went on to add that once the monies are turned over to Bortoloc, Peter would be reimbursed in full. My father paid all her bills up to 5 thousand dollars with no help from Jack, the drunk.
The money eventually was released to Boroloc and my father never found out. My father took It upon himself to call SSI who acknowledged that the funds had been released to Mr. Bortoloc. After several calls to Mr. Bortoloc, he finally released the $1000 check to my father, Peter. However, Mr. Bortoloc still owes my father $4000 dollars for the reimbursement of bills my father had paid. And Bortoloc is court ordered to repay, and is not doing so, where is the money going ,He is in contempt of court. The issue is Bortoloc is filling his pockets. So to this day my father still get my grandmothers bills to his house stating shut off notices. The issue is my father tried to do the right thing for my grandmother and still in the same situation. The news needs to go to her house unexpectedly. He set this up for a show for the news, this is a shame, this is my grandmother well being .I was there during the holidays in Nov, and Jack put a note on the door no one enter or u will be arrested! I entered the house and she is still living the same with Bortoloc in control. What is going on? My father wants a safe environment for his mother, She is 98 years old and alone it that house, with no life alert around her neck is this FAIR!!!!!I called Bortoloc several times and no response. Then he found out I was in town and called me back her grandson, to tell me I need to make an appointment with him to see my grandmother, are u kidding me!!!! SO that's the truth what's going on. There is much more to tell, when I get to Connecticut I will inform the news, and not that nasty news woman Annie Rouke that edited only what she wanted to hear. She should be out of a job, she is supposed be in a neutral corner unreal.

I couldnt believe my ears,i checked her fridge nothing in it nothing.My Father said I though Jack was caring for her he lives here,and wont allow me to enter.So my father checked on her bills,and noticed Jack was using her checks for him self,to mainly to liquor stores,Judge Caruso Knows about this .Then my father changed her checking account,and all her bills were going to him now,to find out Jack has took out several credit cards in her name,and some in his name with here cosigner,racking up the bills over 60 thousand dollars,its all public record several lawsuits against my grandmother and Jack.at this point Jack and his girlfriend Judy Byman, that has a criminal record from stealing,didnt like the idea my father stopped the money going to them.My understanding is that Judy Byman called ssi and had the account frozen,yes she did dont know how that can happen but she did it.so my father took them to probate court.Judge Caruso seen all the evidence and asked my grandmother how does she like the cheap booze she has be buying with her checks.So Caruso asked my father did he want to be conservator.my father declined,its too much of a mess dealing with a drunk Jack.So Caruso appointed Richard Bortolot to take it over.Caruso stated Peter since u started this I will have you pay all ur mothers bills untill Bortolot can get this fixed,and you will be reimbursed in full when ssi releases the funds.So my father paid up to 5 thousand dollars.SSI releases the funds to Bortolot,My father goes back to court now Caruso says Peter u will be paid back 1000 the first month then 75 dollars a month till its paid up what? To this day my father has only recieved 1000 Bortolot is in contemp of court but to go back to Caruso it will cost my father another 150 dollars to have a hearing what is this mess.So back to my grandmother,to this day my father gets my granmother bills still comming to his house with shut off service due to non payment.Bortolot what is he doing, Caurso hired him,so not only Jack helping him self to my grandmothers funds,no it looks like Bortolot is where is the money going.she doesnt have life alert around her neck like she is wanting.Somone needs to go to my grandmothers house when they dont know somone is comming,its a shame whats going on there.So my father is trying to protect his mother by get the help she needs and the meals she needs and a bath.This needs to be looked into more the nice people get burned,the scumbag Jack has been leaching of my grandmother for years,the real scumbag needs to growup and stop using her credit cards for his drinking habbits.Please let the real truth come out.will also send a copy of just Some lawsuits against my grandmother and Jack due to Jack.

I don't know if this man is money hungry, but what I do know is the experience of having to care for an elderly parent who is in dementia. We were faced with the same decision. However, my mother (85) finally agreed to allow my brother and sister-in-law to move in with her and everything has worked out great. The state had stepped in originally because of the fact that her bank account was missing money and my little brother was a co-signer on the account. Today, my brother and sister have decided because of the stress of accounting for every penny, they are turning her finances over to third party to handle. However, knowing our mother as we do, even though she agreed for this decision to be made, she will start screaming soon after this new Payee takes over her finances.

I'm not one to bash the elderly. In fact, I support them more than I do children. However, when a parent is living alone at that age, and the thinking process is beginning to slow, then whether they like it or not, they must have someone with them.

I find it interesting that most of these comments see the son as EVICTING HER for his own greed. However, according to the article, he was only doing this to push his mother into making decision of having someone live with her or go to a nursing home. She could easily hire someone to come in her home for three days a week to be with her and her son would probably be okay with that. At least he has the courage to try and help his mother. It is true that the human being goes through three stages in their lives. Child, Adult, and Child. If this man was to let his mother live as she wants, then everyone would begin screaming when she fell down and broke a hip or had a heart attack because he wasn't there to take care of her. I have only one question. WHAT IS A CHILD TO DO WHEN THE PARENT HE/SHE LOVES IS BEGINNING TO LOSE IT AND IS SO STUBBORN THAT THEY WON'T ALLOW THE CHILD TO HELP THEM?

Actually, it was his brother calling him a scumbag, not the people commenting here - try reading the whole story. Also, a lot of elderly people are just fine on their own, and do not have dementia of any sort. If she does, then that should be addressed; but since she is paying her own bills, retaining a lawyer, and since her other son seems to think she is fine, that doesn't seem to be the case at all here. So if you truly "support the elderly", you might want to get their side before trying to decide what is best for them.

We don't have all the facts but we need to respect our parents and never under any circumstance have them evicted from their own home. I have to say the son doesn't seem to be around enough to show concern. As someone else said, call social services if you are truly concerned. How is the mother supposed to find the money to higher a decent lawyer to fight. Trust me, I know from experience, that it will cost this poor woman a good 50K or more just to help herself. She shouldn't have to live her last few years fighting her money hungry son in court. There is a special place in hell for people like him.

Sadly, courts deal in law, not necessarily justice. If this man has clear legal title to the house, with no provision for his mother to stay there written into the deed, and if he can prove that the property is being neglected, then the courts may well side with him, even if his mother proves that she can take care of herself in most other matters.
