Cummins resigned abruptly in December 2006 and was replaced by J. Timothy Griffin, a former aide to President Bush's senior advisor Karl Rove.

When Cummins, 47, got a call from the Justice Department in 2006 asking him to resign, he was told there was nothing wrong with his performance. As U.S. Attorney for the Eastern District of Arkansas, he investigated FEMA funds fraud after Hurricane Katrina. Media reports also indicate that Cummins increased drug and firearms prosecutions and had helped organize a multiagency counterterrorism council.
